MALKA ELLA ART AUCTION 2023 TERMS AND CONDITIONS

 

1. Bidding and buying

a) Each person wishing to bid in the Malka Ella Fertility Fund (MEFF) Art Auction must register prior to bidding by providing the relevant information as requested by MEFF.

b) The MEFF Art Auction will go live on 14 August 2023, and will close at 14h00 on Monday 28 August. Bids will be accepted for active bidders (an active bidder is someone who had placed a bid on a specific artwork before the auction deadline) and will extend closing time for an additional 2 minutes for the specific artwork. This will continue until no bid is submitted for the specific artwork for a full 2 minutes.

2. First bid prize draw

a) Every first bid on a piece of artwork will go into a draw to win R25000 to spend at Elegance Jewellers, Melrose Arch.

b) The prize is limited to Elegance Jewellers jewellery items, and can be redeemed at the discretion of Management. The prize cannot be used in conjunction with any voucher or discount, or exchanged for cash. Prize is valid for 12 months from date of issue.

c) The winner will be announced by MEFF on social media and by email/mobile, on Tuesday 29 August 2023. An electronic voucher will be sent to the winner via email. 

3. The Auction

a) Works are offered subject to a reserve price.

b) The sale will be conducted in ZAR and any international Bidder/Buyer will be responsible for all exchange rate differences that may occur at any time.

c) MEFF has discretion, at any time, to refuse any bid, withdraw any lot or re-offer an artwork for sale.

d) The highest bidder at the close of the MEFF auction will be the successful purchaser of the artwork. The end of the auction will mark the contract of sale between the Bidder/Buyer and MEFF.

e) All artworks are sold subject to confirmation.

4. Payment

a) The Buyer will be responsible to pay the final price (“Bid Price”) on receipt of an invoice by MEFF.

b) Payments need to be made either by credit card, EFT, or debit order, within 7 days of receipt of the invoice.

5. Delivery/Shipping

a) Artworks will be delivered free of charge in the Johannesburg area.

b) Works will be shipped from MEFF office at Glenstar House, Park Crescent, Glenhazel, Johannesburg 2192.

c) Any fees incurred during the shipping process must be paid for by the buyer.

6. Failure to pay, collect and cancellation of the sale

a) Failure to pay or adhere to payment terms of invoice will result in the cancellation of the sale of the artwork.

b) MEFF may then offer the underbidders the opportunity to purchase the artwork at a set price.

c) MEFF may also auction the artwork again at a later date.

7. Reselling or Reproducing

a) While commissioned pieces can be requested, artworks on the MEFF Art Auction cannot be reproduced, duplicated or copied. This endangers our relationships with artists, and directly jeopardises the charitable work of the MEFF.

8. Section 18a

a) A Section 18a will be issued on 80% of the final Bid Price.

b) 100% of the final Bid Price is payable to MEFF.
